Legal Point-of-View regarding
Architectural Control & the York Woods Community Association Covenants
With respect to the Association's role in enforcing architectural control provisions in the Declaration, it appears that the Association does not have much of a role. From a legal standpoint, nothing in the Declaration explicitly gives the Board or the Association any role in enforcing architectural control. For instance, Article VI, Section 3, which enumerates the powers and duties of the Association, does not mention architectural control. Originally, and as set forth in Article V of the Declaration, architectural control was to be exercised by an Architectural Review Committee. The ARC was composed of four (4) developer appointees, and, in the event of their resignation or death, the developer was supposed to appoint a replacement. It is my understanding that the ARC has not existed for many years and it is not clear how that Committee would be reconstituted. There is probably no “neat and clean” legal way to go about it.
Notwithstanding the foregoing, the Lots at York Woods are subject to the architectural covenants (and other restrictions) contained in the Declaration (as well as any local ordinances). Nothing prohibits individual Lot owners from enforcing the architectural covenants, but it does not appear that the Board or the Association has any role in such enforcement.
